If you are charged with a felony offense, your case will be litigated in the Nassau County, County Court. Misdemeanor offenses are litigated in the Nassau County District Court or either of the two City Courts located within Nassau County; Long Beach City Court or Glen Cove City Court. The determination as to which court you must appear in is based upon two factors. The first factor is the degree of the offense that you are charged with. All felonies in Nassau County are litigated in the County Court, which is located in Mineola. A felony is a crime for which the punishment can exceed one-year incarceration. Misdemeanor cases may be litigated in the Nassau County District Court, Long Beach City Court or Glen Cove City Court. A misdemeanor is a crime for which you can be sentenced to up to one year in jail. The court in which your misdemeanor case will be litigated depends on where you allegedly committed the offense.

 

The first judicial stage of a criminal case is the arraignment. At the arraignment, a person charged with a crime is brought before a judge and informed of the charges that have been filed against him or her. The person has the option to enter a plea of guilty or not guilty to the charges. The Assistant District Attorney and the attorney for the charged individual then make arguments regarding whether or not bail should be set. The judge, after taking each of the arguments into account then decides whether to impose bail and the amount of the bail that the person will be held on if any. Having a qualified attorney represent you at the arraignment can make the difference between remaining incarcerated on a high bail or being released without bail.
